Aether (operated by radioaether.com, "we", "us") is a platform for sharing and listening to AI‑assisted music. These terms, the content & AI policy, the copyright process, and the privacy notice below together govern your use of the service. By creating an account or using Aether, you agree to them. If you do not agree, please do not use the service.

1. Terms of Service

These terms form a binding agreement between you and radioaether.com (Aether). We may update them; material changes will be announced in‑product or by email, and continued use after changes means you accept them.

2. Eligibility & accounts

You must be at least 14 years old (or the age of digital consent in your country) to use Aether. You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it current. You may delete your account at any time; we may suspend or terminate accounts that violate these terms.

3. Acceptable use

You agree not to: upload content you do not have the rights to; infringe anyone's intellectual property, privacy, or other rights; post unlawful, hateful, harassing, deceptive, or sexually exploitative material; impersonate others; spam, scrape, or abuse the service or other users; attempt to bypass security, rate limits, or bot protections; or use the service to train machine‑learning models on other users' content without permission. We may remove content and restrict accounts that break these rules.

4. Your content & AI music

You keep your rights. You retain ownership of the tracks, artwork, text, and other content you upload ("Your Content"), to the extent you hold those rights. Aether does not claim ownership of Your Content.

You are responsible for what you upload. You represent and warrant that you have all rights necessary to upload Your Content and to grant the license below, and that Your Content does not infringe or violate any third party's rights or any law.

AI‑generated music. The legal status of AI‑generated works is evolving and varies by jurisdiction. If you create music with tools such as Suno, Udio, or others, you are responsible for complying with those tools' own terms of service and for ensuring you hold sufficient rights in the output you upload. Aether does not provide legal advice on the ownership or protectability of AI‑generated works, and makes no representation that any output is free of third‑party rights.

5. License you grant to Aether

So we can operate the service, you grant Aether a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, stream, publicly perform, display, and distribute Your Content, and to make technical copies and create previews/waveforms, solely for the purpose of operating, promoting, and improving the service. This license ends when you delete the content or your account, except for: (a) copies retained in routine backups for a limited period, and (b) content others have downloaded or shared where permitted. We do not sell Your Content or license it to third parties to train AI models.

7. Privacy notice (GDPR)

Data controller. radioaether.com is the controller of personal data processed through the Aether service. For any privacy request, contact inquiries@radioaether.com.

What we process. Account data (email, hashed password, handle, profile details you provide); content you upload (tracks, artwork, descriptions); social and usage data (follows, friends, messages, comments, reactions, play events); and technical data needed to run and secure the service.

Why, and legal bases. To provide the service and your account (performance of a contract, Art. 6(1)(b) GDPR); to keep the platform safe and prevent abuse, including bot protection and rate limiting (legitimate interests, Art. 6(1)(f)); and, where applicable, on your consent (Art. 6(1)(a)), which you can withdraw at any time.

Processors & transfers. We rely on a small number of trusted third‑party providers to operate Aether (radioaether.com) — covering cloud hosting and infrastructure, database and authentication, file storage, and security/anti‑abuse — who process data on our behalf under data‑processing agreements. Some processing may occur outside the EU/EEA; where it does, appropriate safeguards such as the European Commission's Standard Contractual Clauses apply. The current list of processors is available on request at inquiries@radioaether.com.

Your rights. You may access, rectify, erase, restrict, or object to processing of your personal data, and request portability. You can delete your tracks and your account at any time in‑product. You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali, www.garanteprivacy.it) or your local supervisory authority.

Retention & cookies. We keep personal data only as long as needed to provide the service or meet legal obligations, after which it is deleted or anonymized. Aether (radioaether.com) uses only the cookies/local storage strictly necessary to sign you in and run the app; we do not use advertising trackers.

8. Disclaimers & limitation of liability

User‑generated content. Aether (radioaether.com) is a hosting service. Content is created and uploaded by users; we do not pre‑screen it and are not its author. Views expressed in user content are those of the users, not Aether.

"As is". The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted, error‑free, or that content is accurate or non‑infringing.

Liability. To the maximum extent permitted by applicable law, radioaether.com is not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill arising from your use of the service. Nothing in these terms excludes or limits liability that cannot be excluded or limited under mandatory law, including rights you may have as a consumer under Italian and EU law.

9. Governing law & contact

These terms are governed by the laws of Italy, without prejudice to mandatory consumer‑protection rules of your country of residence within the EU. Disputes are subject to the competent courts of Italy, except where mandatory law gives you the right to bring proceedings elsewhere.
